General Terms and Conditions (GTC)

Introduction
These General Terms and Conditions (“THE LOST EXIT GTC”) together with the Privacy Policy regulate the use of THE LOST EXIT platform, accessible at https://www.thelostexit.ie.
Service Provider:
FunFactory 4 You (registered office: 35 Cluain na Sibhe, Killashee, Co. Longford, Ireland, company registration number: 733672) – as the owner and operator of the https://www.thelostexit.ie website (hereinafter: “Service Provider”).
User: the person using the service.
By using the Website, the User accepts the Terms and Conditions and commits to complying with them.

2. Subject and Scope of the Contract

These GTC apply to the online booking of escape room services accessible through the website operated by the Service Provider and to the legal relationship thus created.
The GTC only apply to online bookings. Bookings made in person or through a third party are subject to separate agreements.

3. Website Use and Security

By using the website, you accept the provisions of the GTC.
Use of the website alone does not constitute contract conclusion or create a legal relationship between the User and the Service Provider. The contract is concluded only when the User places a booking through the website and the Service Provider confirms it by email.
Information on the website is for informational purposes only and may be modified by the Service Provider at any time without prior notice.
All content on the website is owned by the Service Provider or published with lawful authorization; copying, distribution, or commercial use is prohibited.
Users must comply with all applicable laws and the provisions of this GTC when using the website. Use of the website is always at the User’s own risk.

4. Booking and Payment

The User is responsible for the accuracy of the data provided during booking.
Booking confirmation is sent by email and serves as the entry ticket.
Booking is made through the website with online payment.
Full payment is required to finalize the booking.
Prices are quoted in euros (EUR), and the Service Provider is not subject to VAT. If legal changes introduce new taxes or fees, the Service Provider may adjust prices accordingly.
In case of erroneous or double charges, the Service Provider will refund the paid amount promptly, no later than within 7 business days.

5. Cancellation, Modification, No-show Policy

Bookings can be canceled or modified free of charge up to 48 hours before the scheduled time (in writing, by email).
Cancellations within 48 hours or no-shows will be charged the full fee, no refunds possible.
In exceptional cases (e.g., severe illness, family bereavement), the Service Provider may consider refunding the fee or rescheduling upon presentation of official documentation.
If the Service Provider cancels the game (e.g., technical failure, staff shortage), they will primarily offer a new date. If that is not acceptable to the User, the full paid amount will be refunded.
Please note that under Irish and EU consumer protection laws, the 14-day withdrawal right without justification does not apply to leisure services provided on a specific date and time (such as escape room bookings).
Thus, the booking is final and can only be modified or canceled under the conditions set in the GTC.

6. Participation Conditions

Games can be played by a minimum of 2 and a maximum of 10 persons (depending on the room).
Children under 6 may participate only if accompanied by an adult (+18).
Teams under 16 must have at least one adult (+18) present during the game.
Persons under the influence of alcohol or drugs are not allowed to participate.
Users must inform the Service Provider in advance about any known health conditions or allergies (e.g., epilepsy, cardiovascular diseases, respiratory problems, asthma, severe allergies) that could pose risks due to thematic elements used during the game (dark rooms, flashing lights, fog machine, sound effects, etc.).
The Service Provider is not responsible for health issues about which the User did not provide prior information.
By booking, the User acknowledges that participation is at their own risk, and a separate health and liability declaration may need to be signed on-site.

7. Game Rules and Conduct

Video or audio recording during the game is prohibited.
Players must use equipment as intended; intentional damage may result in compensation claims by the Service Provider.
Players must follow staff instructions.
Harassment or aggressive behavior may lead to refusal or immediate termination of service by the Service Provider. In such cases, no refund will be issued, and compensation claims may apply.

8. No-show and Late Arrival

The game starts at the booked time.
Late arrivals may shorten the game time; a delay over 15 minutes may result in refusal of participation without refund.
In case of no-show, the full fee is retained by the Service Provider.

9. Use and Damage of Equipment

It is prohibited to force open, tamper with, or misuse any game items.
All elements (locks, doors, compartments) can be opened logically without tools or physical force.
If an item doesn’t open easily, it means the necessary key, code, or solution is not yet available.
Guests must use equipment properly.
Any intentional or negligent damage (e.g., breakage, graffiti, vandalism) may lead to compensation claims.

10. Limitation of Liability

The Service Provider is not liable for injuries sustained by players unless caused by negligence or breach of safety regulations by the Service Provider.
Players participate at their own risk and must inform staff of any health issues.
The Service Provider is not liable for damages resulting from improper conduct, health problems, or breach of game rules by the User.
Liability is limited to the service fee.
The Service Provider is not responsible for loss or damage of personal belongings during the game.

11. Exclusion of Liability Regarding Thematic Experience Elements

During the escape room game, participants may encounter various intense physical and/or psychological thematic elements, including but not limited to:

  • dark rooms,
  • sudden sound effects,
  • light and flashing effects,
  • artificial smoke, fog machines,
  • thematically frightening or unsettling visual elements (e.g., blood effects, “ghosts,” horror elements).

These elements enhance the game experience and are applied safely, professionally controlled, and tested.
Players participate at their own risk and must inform staff if known health conditions (e.g., epilepsy, panic disorder, PTSD, allergies, asthma) could be affected.
By starting the game, participants acknowledge that these thematic elements are not harmful per se and that the Service Provider is not liable for psychological or emotional reactions unless caused by negligence or technical failure.

12. Child and Minor Participation Policy

Age and Participation Conditions
Minimum age for participation is 6 years.
Persons under 18 may participate only with an adult (+18) escort.
For teams under 18, at least one adult (+18) must be present during the entire game.
Parents or guardians are responsible for the child and accept liability for any behavior or damages.
Due to thematic elements (dark rooms, light and sound effects, frightening elements), some rooms are not recommended for children under 14; please consult staff.

Safety Considerations
Frightening or stressful elements may occur during the game. The adult escort is always responsible for minors.
The adult must supervise children’s behavior and ensure game rules are followed.
Adults under the influence of alcohol or drugs may not participate with children.

Data Protection (GDPR requirements)

Personal data of children under 18 (e.g., name, email, phone number) are processed only with parental or legal guardian consent.
During booking, the adult escort’s data must be provided, not the child’s.
The Service Provider collects and stores no more data about children than strictly necessary for safe service provision.

Liability Declaration
By booking, the adult escort declares responsibility for the minor participant for the entire duration of the game.
The Service Provider is not liable for psychological or emotional reactions from children’s participation predictable from the thematic nature of the game, except in cases of negligence or technical failure by the Service Provider.

13. Accessibility and Guests with Special Needs

The Lost Exit welcomes all guests but must inform visitors about physical characteristics of the venue and game-related specifics.
Due to narrow corridors and doors, the building is not considered fully accessible, and wheelchair or mobility aids may face difficulties.
Certain puzzles and items are located at heights not reachable directly from a wheelchair.
The game mainly relies on visual and auditory cues (e.g., recognizing signs, noticing objects, soft sounds, key or door noises), which may make independent play difficult for guests with vision or hearing impairments.
Guests with special needs are welcome if supported by team members or companions.

The Service Provider takes all reasonable measures to make the game enjoyable for guests with special needs.
Staff are ready to assist and offer alternative solutions to preserve game experience.
Please notify during booking if your group includes guests with special needs for optimal arrangements.

14. Force Majeure

The Service Provider is not liable for events beyond their control that prevent temporary or permanent service provision, including but not limited to:

  • natural disasters (floods, earthquakes, storms),
  • epidemics, public health emergencies,
  • war, terrorist acts, riots, mass disturbances,
  • fire, explosion, technical accidents,
  • governmental or authority measures, decrees, bans,
  • nationwide or local power outages, internet or telecommunication failures.

In such cases, the Service Provider may cancel bookings and will endeavor to notify affected Users promptly.
The User has no right to damages for such cancellations but may be offered alternative dates or refunds.

15. Personal Data Processing

The Service Provider processes personal data only as necessary to provide the services, according to applicable data protection laws.
The Privacy Policy available on the website governs data processing.
Users have rights to access, rectify, delete, restrict processing, and object to data processing.

16. Governing Law and Jurisdiction

The relationship between the Service Provider and the User is governed by Irish law.
Disputes are subject to the exclusive jurisdiction of Irish courts.
Alternative dispute resolution options are available through the Competition and Consumer Protection Commission (CCPC) or European Online Dispute Resolution (ODR) platform.

17. Camera Policy – The Cameras Are For You

The moment you step into the escape room, you’re not the only one getting ready for action—the cameras start rolling too… but don’t worry, it’s all for your safety and to enhance your experience!

So, why are there cameras in the room?

Safety Above All!
The Game Master watches the game live to intervene immediately if something isn’t right. This way, you can focus on your mission with complete peace of mind.

Game Monitoring and Support
The cameras help us see how you’re progressing with the puzzles. This way, if you get stuck, you can receive timely help, right when you really need it.

By entering the game area, you accept that you will be monitored by cameras and that recordings may be made for security, documentation, or marketing purposes. The camera system is always active for security and game-tracking. However, any recordings used for marketing or as souvenirs are made only with your explicit consent.

And one more thing… The cameras are real, and they’re there for you, but you do not need to open, pry, or tamper with them. There is no code for them…

Before starting the game, every player is required to complete and accept the following declarations on site:

If any provision of this GTC is invalid, it does not affect the validity of the remaining provisions.
The Service Provider may amend these GTC at any time, with updates published on the website.
